Reminders for Covered Persons and the General Public About Suspicious Transactions During the Election Period

The Anti-Money Laundering Council (AMLC) reminds covered persons of their duty under Republic Act No. 9160, otherwise known as the Anti-Money Laundering Act of 2001, as amended (AMLA), along with its implementing rules and regulations, to submit reports on all suspicious transactions promptly and diligently, especially during the current election period.

Section 3(b-1) of the AMLA states that transactions are considered suspicious if any of the following circumstances exist:

  1. There is no underlying legal or trade obligation, purpose or economic justification;
  2. The client is not properly identified.
  3. The amount involved is not commensurate with the business or financial capacity of the client;
  4. Taking into account all known circumstances, it may be perceived that the client's transaction is structured in order to avoid being the subject of reporting requirements under the Act;
  5. Any circumstance relating to the transaction which is observed to deviate from the profile of the client and/or the client's past transactions with the covered person;
  6. The transaction is in any way related to an unlawful activity or offense under this Act that is about to be, is being or has been committed; or
  7. Any transaction that is similar or analogous to any of the foregoing.
  8. Any transaction in which such circumstances exist, regardless of the amount, shall be reported to the AMLC in accordance with the Guidelines on Transaction Reporting and Compliance Submissions (GoTRACS).

The AMLC strongly advises the public to avoid transactions with individuals and entities, whether they are candidates or not, who participate in vote-buying. The AMLC advocates for free, orderly, honest, peaceful, and credible elections while emphasizing fair electoral practices.

Pinapaalalahanan ng Anti-Money Laundering Council (AMLC) ang mga covered persons ukol sa kanilang tungkulin na nakasaad sa Republic Act No. 9160, o ang Anti-Money Laundering Act of 2001, as amended (AMLA), na magsumite ng suspicious transaction reports (STRs) kung may mga kahina-hinalang transakyson na pinadaan sa kanilang institusyon lalo na ngayong panahon ng eleksiyon.

Ang transaksyon ay maaaring masabing kahinahinala kung ito ay may koneksyon sa mga sitwasyon o kalagayan na nakasaad sa Section 3(1-b) ng AMLA.

Ang mga covered persons ay pinapayuhang magsumite ng STR ayon sa Guidelines on Transaction Reporting and Compliance Submissions (GoTRACS).

Mariin ding hinihikayat ng AMLC ang publiko na huwag makipag-ugnayan sa mga indibidwal, kandidato man o hindi, na maaaring sangkot sa mga aktibidad na labag sa batas ngayong panahon ng eleksyon gaya ng pagbili ng mga boto.

Advisory on the Rising Incidents of Use of Fraudulent Documents and Communications by Persons Misrepresenting to be Coming from, Connected with, or Related to, the Anti-Money Laundering Council

Paalala Ukol sa Tumataas na Insidente ng Paggamit ng mga Dokumento at Komunikasyon ng mga Taong Nagpapanggap na Galing, Konektado, o May Kaugnayan sa Anti-Money Laundering Council

The Anti-Money Laundering Council (AMLC) warns the public to remain vigilant in light of the rising incidents of use of fraudulent documents and communications by individuals or entities misrepresenting to be coming from, connected with, or related to the Anti-Money Laundering Council (AMLC).

These unscrupulous individuals and entities usually use the AMLC’s official seal/logo in their letters, notices, e-mails, messages, and other documents and communications, and sign with the names or signatures of AMLC officers or staff—present, past, or even fictitious—to obtain financial benefits or personal information. Further, they create fake Telegram, Facebook, Messenger, Viber, or Whatsapp accounts using the AMLC’s official seal/logo to coerce their victims to enter into a loan agreement or pay out a certain sum for the release of inexistent funds or parcels.

The AMLC vehemently denies ownership of these kinds of documents and communications. In this regard, the AMLC urges the public to refrain from dealing with these scammers or fraudsters.

The act of maliciously using the official seal/logo of, and misrepresenting the AMLC or any of its personnel or units is punishable under the law. The public is strongly encouraged to verify the authenticity of documents and messages received from, or transactions carried out with, supposed AMLC representatives.

Pinag-iingat ng Anti-Money Laundering Council (AMLC) ang publiko sa tumataas na insidente ng paggamit ng mga dokumento at komunikasyon ng mga indibidwal o grupo na nagpapanggap na galing, konektado, o may kaugnayan sa AMLC.

Ang mga taong ito ay kadalasang ginagamit ang tatak ng AMLC sa mga “Notice”, “Letter”, o “Notification” at gumagamit ng pangalan at lagda ng empleyado, opisyal, o kinatawan ng AMLC. Gumagawa din ang mga kawatan ng mga fake na Facebook Messenger, Telegram, Whatsapp, o Viber AMLC accounts upang makapanlinlang ng publiko. Pinapayuhan ang publiko na suriing mabuti ang mga mensaheng natatanggap o transaksyong inaalok mula sa mga ito.

Mariing itinatanggi ng AMLC ang anumang komunikasyon o dokumentong nagsasabi na kinakailangan magbayad ng penalty para sa paglabas, paglilipat ng pondo (fund transfer) at /o paglabas ng mga kalakal, premyo at pera. Hinihimok ng AMLC ang  publiko na iwasang makipag-ugnayan sa mga nasabing manloloko.

Ang mapanlinlang na paggamit ng tatak ng AMLC, at ang pagpapanggap biling kawani ng AMLC  ay may kaukulang kaparusahan sa batas. Ang publiko ay mariing hinihikayat na busisiing mabuti ang pagiging tunay ng mga dokumento at mensahe  na natatanggap, o ang mga transaksyong ipinapatupad ng mga nagpapanggap na kawani ng AMLC.

Re-registration of Covered Persons under the CORS on or before 29 April 2025 and Implementation of Chapter II, Part 1, Items 1.18 & 1.19 of the GoTRACS on 01 May 2025

This serves as an updated advisory regarding the Re-registration of covered persons (CPs) under the Compliance Optimization and Registration System (CORS). The re-registration must be completed on or before 29 April 2025, and the forthcoming implementation of Chapter II, Part 1, Items 1.18 & 1.19 in the Guidelines on Transaction Reporting and Compliance Submission (GoTRACS) is on 01 May 2025. All Covered Persons to Deal Only with Designated Non-Financial Businesses and Professions Registered with the AMLC

     AMLC Resolution No. 81 dated 09 May 2019 directed the issuance of an advisory to covered persons (CPs) dealing with clients who are classified under the sector of Designated Non-Financial Businesses and Professions (DNFBPs) to demand presentation of their Certificate of Registration (COR) or Provisional COR (PCOR) with the AMLC as part of Customer Due Diligence (CDD) measures under Section 3.5(b)(1) of the 2018 Implementing Rules and Regulations of the AMLA, as amended. Failure of a DNFBP to supply its P/COR is a ground to conduct enhanced due diligence measure (EDD) and/or to re-evaluate the business relationship. On the part of the CP failing to comply with this directive, it may be cited for the applicable administrative sanctions under the Rules of Procedure in Administrative Cases (RPAC).

 

     All CPs must deal only with registered DNFBPs with valid or subsisting P/COR or may risk being cited for a Serious Violation under Section 2(C)(25), Rule IV, of the RPAC.

 

     The updated list of Registered DNFBPs as of 28 February 2025 is posted at Registered DNFBPs.

 

   For the names of newly registered DNFBPs not yet included in the list, CPs may contact for confirmation/validation the Registration Staff of the Compliance and Supervision Group, Detection and Prevention Department, at telephone numbers (632) 5302-3848, 5310-3244, 8708-7067.
